ABOUT THE BOOK: The impact of public law depends on how politicians secure control of public organizations, and how these organizations in turn are used to define national security. Governing Security explores this dynamic by investigating the surprising history of two major federal agencies that touch the lives of Americans every day: the Roosevelt-era Federal Security Agency (which became today's Department of Health and Human Services) and the more recently created Department of Homeland Security.Through the stories of both organizations, Cuéllar offers a compelling account of crucial developments affecting the basic architecture of our nation. He shows how Americans end up choosing security goals not through an elaborate technical process, but in lively and overlapping settings involving conflict over agency autonomy, presidential power, and priorities for domestic and international risk regulation. Ultimately, as Cuéllar shows, the ongoing fights about the scope of national security reshape the very structure of government, particularly during—or in anticipation of—a national crisis.

Actors in government, civil society, and academia have been pioneering innovative approaches to advance transparency, accountability, and democracy around the world. Citizen engagement is at the forefront of democratic practices worldwide and a key pillar to support civil society is access to information.

Andrea Sanhueza, a 2012 Draper Hills Summer fellow, shares her success story of how a group of civil society organizations helped advocate for improved environmental governance cooperation across government and civil society in Latin America and the Caribbean region.

Sanhueza has been an active civil society stakeholder in the Summit of the Americas process, which works to build regional cooperation among governments of the Western Hemisphere. In 2009, Sanhueza drafted a strategy for the Organization of American States (OAS) to structure participation of civil society organizations in OAS activities. From 2001-2010, she served as the executive director of PARTICIPA, a Chilean NGO that works in the democracy field on issues of elections, transparency, access to information, and citizen participation.

 

What is The Access Initiative?

Founded in 2000, The Access Initiative (TAI) is a global coalition of civil society organizations that work towards the implementation of the right to access of information, participation and justice regarding environmental issues. These rights —known as access rights — are included in Principle 10 of the Río Declaration that was signed at the first Earth Summit in 1992.

 

Why are access rights important?

Access rights are key for democracy and governance because they are the foundation for exercising human rights. If a person can have access to information about a public issue (education, health, or pension) and can participate in a meaningful way, then he/she will be able to effectively exercise their rights. Without access to information — which is the major building block — it is almost impossible to exercise human rights.

Since its founding, TAI has been dedicated to improving citizens’ access to environmental decision-making, strengthening the enforcement of environmental law and policy, combating corruption, and realizing human rights.

 

What has been one of The Access Initiatives' key milestones?

In June 2012, the second conference on sustainable development took place in Brazil, known as the Río+20 Summit. TAI came together to advocate for the advancement of access rights for countries in the Latin American and Caribbean region.

I visited the government of Chile — specifically the Foreign Affairs Ministry and the Ministry of the Environment — to let them know about the TAI proposal for a regional convention. The proposal included evidence-based advocacy to encourage collaboration across government and civil society and promote innovation that advances transparency, accountability, and inclusiveness of civil society at all levels.

The government of Chile submitted the TAI proposal for a regional convention on the Principal 10 Declaration to the U.N. The governments of Jamaica and Brazil also submitted the TAI proposal and showed their support. This was a milestone in the longer process.

 

How were you and your partners successful in convincing other governments to support TAI?

TAI was successful in getting other governments on board to support the initiative through a strategic partnership with the government of Chile who was key to getting other governments to sign the declaration.

TAI and representatives of the government of Chile started advocating during the preparatory meetings of the summit to other governments. We encouraged them to join this proposal for the advancement of access rights for countries in the Latin American and Caribbean region. After two years of advocating for the relevance of a regional instrument in the declaration, we had 11 governments supporting our proposal for the development of a regional instrument to strengthen access to information, public participation, and access to justice in sustainable development decision‐making. These governments include: Brazil, Costa Rica, Chile, the Dominican Republic, Ecuador, Jamaica, Mexico, Panama, Paraguay, Peru, and Uruguay.

 

What was the outcome of this collation of governments in the Latin American and Caribbean region?

The signatory governments committed to drafting and implementing a Plan of Action 2012-14, to work towards an international instrument. The U.N. Economic Commission for Latin America and the Caribbean (ECLAC) is serving as the technical secretariat for the process.

In November 2012, ECLAC hosted the first meeting of representatives appointed by the signatory governments in Santiago, Chile. The representatives agreed on a roadmap that defines the next steps for the collation and appointed a steering committee composed of the governments of Chile, Dominican Republic, and Mexico to coordinate the process.

 

What role does civil society play in advancing environmental democracy?

The participation of civil society in the development of a Latin American and Caribbean Principle 10 instrument is essential to the process. There now exists a real opportunity to advance environmental democracy and access rights in the Latin American and Caribbean region. Civil society's participation would ensure that the instrument is capable of actually strengthening public institutions in the region, and ensure its legitimacy and viability as a tool to strengthen environmental governance for sustainable development. Governments have committed to a participatory process, but this commitment will not materialize if civil society lacks the actual capacity to participate in the relevant meetings of the process.

 

What does the future hold for TAI?

We are very excited about the possibility of creating a regional instrument for the efficient implementation of access rights in Latin American and Caribbean region. Today there is a real opportunity for both governments and civil society to promote good environmental governance through implementation of the LAC Principle 10 Declaration. The dec­laration is still open for signature by other Latin American and Caribbean countries, and it is expected that more countries will join the process and lend increased vigor to this innovative approach to regional coopera­tion on environmental governance.

More than 2,860 American and allied troops have been killed in the Afghanistan war, which was launched in the wake of the 9/11 terrorist attacks to avenge the deaths of nearly 3,000 civilians. As many as 17,500 Afghan civilians have lost their lives in America's second-longest war. The U.S. military intends to withdraw its combat troops from Afghanistan by the end of 2014, closing a chapter in American history that has largely been dropped from the headlines and the collective consciousness of the American people.

Stanford scholars and military experts, including Karl Eikenberry, Joseph Felter, J.B. Vowell, Viet Luong, Anja Manuel and Erik Jensen, talk about the lessons learned, the gains and losses and what to expect after the war formally comes to an end.

Yasuaki Hanai, "Are Japanese Electric Companies Becoming Obsolete? –  Rethinking Strong Points for Japanese Electric Companies

In recent years, it has become very common to take pictures using a smart phone or tablet, such as an iPad, and to share this information via social media outlets such as Facebook, Twitter and Instagram.  Japanese electric companies and products have been noticeably absent from this area, except for the single-lens reflex camera.  How has this happened?  Why have Japanese electric companies suffered a decline?  In his research, Hanai tries to answer these questions by analyzing the financial reports of various Japanese companies after the bubble economy collapse.  Hanai also considers strong points for Japanese electric companies and what the next actions should be to reverse the decline.

Saiko Nakagawa,  "Systemic Risks in the Japanese Banking Sector"

“Systemic risk” has become a buzzword after the global financial crisis in 2007-08.  Due to its elusive nature, there have been active discussions among scholars, international organizations and national regulators on how to measure and address the risk in order to prevent the next crisis.  In her presentation, Nakagawa will introduce these recent discussions and argue the implications to Japan’s financial sector.

Masashi Suzuki, "Dismal Software Industry in Japan – Will It Be Disrupted or Will It Discover Its Own Way like U.S. Players?"

In his research, Suzuki provides an historical analysis of the software market in Japan and the United States as well as a comprehensive analysis of the status quo of these two countries. Are there ways to improve the unfavorable situation in Japan?  Suzuki attempts to provide an answer to this question in his research presentation. 

Bin Wang, "Innovation and New Venture Strategies in China"

In recent years, entrepreneurship has played an increasing role in promoting economic growth in China.  The Chinese government began to pay more attention to encourage entrepreneurship in order to reform the economic structure.  Wang’s research examines the characteristics of the emerging industry and reveals a positive relationship between innovation capabilities and growth of new venture.  He developed a framework to classify new venture strategies based on market characteristics and innovation capabilities, identified ten strategic types, and reviewed their impact on performance in new ventures in China.  Wang’s research attempts to provide important guidelines for venture capital to identify potential investment opportunities.  These guidelines will also help entrepreneurs to identify an appropriate strategy to pursue business opportunities in given situations.

Abstract:

The U.S. and the E.U. are often seen as fundamentally different democracy promoters. It has been argued that the U.S. has a more political approach, which is confrontational vis-à-vis host governments and promotes democracy bottom-up via civil society. The E.U., on the other hand, is perceived as more developmental, focusing on non-confrontational projects that are mostly top-down or focused on civil society organizations not critical of the government. The U.S.’s political approach has been criticized for being too donor-led, unilateral, and hardly respecting country ownership. But should American democracy assistance become more European?

Based on research on E.U. and U.S. democracy assistance programs in Ethiopia, CDDRL Postdoctoral Fellow Karen Del Biondo explains the causes and consequences of a political and developmental approach to democracy assistance. She argues that the E.U. has indeed taken a more developmental approach, which can be explained by the European Commission’s commitment to the Paris Declaration principles on aid effectiveness, including ownership, alignment and, harmonization. This was possible because of the relatively autonomous position of the Commission vis-à-vis the Member States and the European Parliament. In contrast, USAID does not enjoy this bureaucratic autonomy, and has therefore paid lip service to aid effectiveness. Del Biondo discusses the advantages and disadvantages of a political and developmental approach in a semi-authoritarian regime such as Ethiopia. She finds that, although the impact of E.U. democracy assistance in Ethiopia can be questioned, the E.U.’s developmental approach has made the government of Ethiopia more open to E.U. democracy assistance, while the U.S.’s political approach led to a backlash.

Karen Del Biondo is a 2012-2013 postdoctoral fellow at the CDDRL. Her research is funded with a Fulbright-Schuman award and a postdoctoral grant from the Belgian-American Educational Foundation (BAEF). She holds an MA in Political Science (International Relations) from Ghent University and an MA in European Studies from the Université Libre de Bruxelles. In 2007-2008 she obtained a Bernheim fellowship for an internship in European affairs at the Belgian Ministry of Foreign Affairs and Permanent Representation to the EU. 

Karen Del Biondo obtained her PhD at the Centre for EU Studies, Ghent University in September 2012 with a dissertation entitled ‘Norms, self-interest and effectiveness: Explaining double standards in EU reactions to violations of democratic principles in sub-Saharan Africa’. Her PhD research was funded by the Flemish Fund for Scientific Research (FWO). Apart from her PhD research, she has been involved in the research project ‘The Substance of EU Democracy Promotion’ (Ghent University/University of Mannheim/Centre of European Policy Studies) and has published on the securitisation of EU development policies. In January 2011 she conducted field research in Addis Ababa, Ethiopia. Her postdoctoral research will focus on the comparison between EU and US democracy assistance in sub-Saharan Africa.

The Stanford Law School celebrated CISAC Co-Director Tino Cuéllar’s new book, Governing Security: The Hidden Origins of American Security Agencies, which was recently published by Stanford University Press.

“I love a book party because we’re all devoted to the advancement of knowledge, but we all know it’s really hard to do and it’s not always appreciated when we do it,” Stanford Law School Dean Mary Elizabeth Magill told a gathering of law faculty to honor the book by Cuéllar, a law professor who also will be the next director of CISAC’s umbrella organization, the Freeman Spogli Institute for International Studies. The law faculty were also honoring law professor Michele Landis Dauber’s new book, “The Sympathetic State: Disaster Relief and the Origins of the American Welfare State.”

Cuéllar’s book explores the history of two major federal agencies: the Roosevelt-era Federal Security Agency – today the Department of Health and Human Services – and the Department of Homeland Security, established in the wake of the 9/11 terrorist attacks. Through the stories of both agencies, Cuéllar shows how Americans often end up choosing security goals through overlapping ambitions and conflicts over agency autonomy, presidential power and gut reactions to national security crises.

“More than other academic monographs which tend to be dry, impersonal affairs, I could see the person behind the prose in this book,” David Engstrom, an assistant law professor, told the gathering. “In the introduction, Tino crafts a beautiful metaphor by noting how easy it is to stand just to the north of the United States-Mexico border and to think that it’s somehow timeless, and to forget that it was state action that made that border such a consequential part of the social world for so many people. Now as you read, you soon realize that this book really isn’t about nation-state borders, in that sense, but rather about the border between domestic policy and national security and about the boundaries between public agencies.

“But then you also realize,” Engstrom continued, “Who better than Tino, who grew up along that U.S.-Mexico border, first to see and then to show us how seemingly arbitrary borders and boundaries can, through administrative action, become so consequential.”

Abbas Milani is the Hamid and Christina Moghadam Director of Iranian Studies at Stanford University and a visiting professor in the department of political science. In addition, Dr. Milani is a research fellow and co-director of the Iran Democracy Project at the Hoover Institution.

Prior to coming to Stanford, Milani was a professor of history and political science and chair of the department at Notre Dame de Namur University and a research fellow at the Institute of International Studies at the University of California at Berkeley. Milani was an assistant professor in the faculty of law and political science at Tehran University and a member of the board of directors of Tehran University's Center for International Studies from 1979 to 1987. He was a research fellow at the Iranian Center for Social Research from 1977 to 1978 and an assistant professor at the National University of Iran from 1975 to 1977.

Dr. Milani is the author of Eminent Persians: Men and Women Who Made Modern Iran, 1941-1979, (Syracuse University Press, Syracuse, NY, 2 volumes, November, 2008); King of Shadows: Essays on Iran's Encounter with Modernity, Persian text published in the U.S. (Ketab Corp., Spring 2005); Lost Wisdom: Rethinking Persian Modernity in Iran, (Mage 2004); The Persian Sphinx: Amir Abbas Hoveyda and the Riddle of the Iranian Revolution (Mage, 2000); Modernity and Its Foes in Iran (Gardon Press, 1998); Tales of Two Cities: A Persian Memoir (Mage 1996); On Democracy and Socialism, a collection of articles coauthored with Faramarz Tabrizi (Pars Press, 1987); and Malraux and the Tragic Vision (Agah Press, 1982). Milani has also translated numerous books and articles into Persian and English.

Milani received his BA in political science and economics from the University of California at Berkeley in 1970 and his PhD in political science from the University of Hawaii in 1974.

Målfrid Braut-Hegghammer is an Associate Professor of Political Science at the University of Oslo. She first joined CISAC as a visiting associate professor and Stanton nuclear security junior faculty fellow in September 2012, and was a Stanford MacArthur Visiting Scholar between 2013-15. Between 2008 and 2010 she was a predoctoral and postdoctoral fellow at Harvard University's Belfer Center for Science and International Affairs. Braut-Hegghammer received her PhD, entitled “Nuclear Entrepreneurs: Drivers of Nuclear Proliferation” from the London School of Economics in 2010. She received the British International Studies Association’s Michael Nicholson Thesis Prize that same year for her work.

Scott D. Sagan is Co-Director and Senior Fellow at the Center for International Security and Cooperation, the Caroline S.G. Munro Professor of Political Science, and the Bass University Fellow in Undergraduate Education at Stanford University. He also serves as Co-Chair of the American Academy of Arts and Sciences’ Committee on International Security Studies. Before joining the Stanford faculty, Sagan was a lecturer in the Department of Government at Harvard University and served as special assistant to the director of the Organization of the Joint Chiefs of Staff in the Pentagon.

Sagan is the author of Moving Targets: Nuclear Strategy and National Security (Princeton University Press, 1989); The Limits of Safety: Organizations, Accidents, and Nuclear Weapons (Princeton University Press, 1993); and, with co-author Kenneth N. Waltz, The Spread of Nuclear Weapons: An Enduring Debate (W.W. Norton, 2012). He is the co-editor of Insider Threats (Cornell University Press, 2017) with Matthew Bunn; and co-editor of The Fragile Balance of Terror (Cornell University Press, 2022) with Vipin Narang. In 2022, Sagan was awarded Thérèse Delpech Memorial Award from the Carnegie Endowment for International Peace at their International Nuclear Policy Conference. In 2017, he received the International Studies Association’s Susan Strange Award which recognizes the scholar whose “singular intellect, assertiveness, and insight most challenge conventional wisdom and intellectual and organizational complacency" in the international studies community. Sagan was also the recipient of the National Academy of Sciences William and Katherine Estes Award in 2015, for his work addressing the risks of nuclear weapons and the causes of nuclear proliferation. The award, which is granted triennially, recognizes “research in any field of cognitive or behavioral science that advances understanding of issues relating to the risk of nuclear war.” In 2013, Sagan received the International Studies Association's International Security Studies Section Distinguished Scholar Award. He has also won four teaching awards: Stanford’s 1998-99 Dean’s Award for Distinguished Teaching; Stanford's 1996 Hoagland Prize for Undergraduate Teaching; the International Studies Association’s 2008 Innovative Teaching Award; and the Monterey Institute for International Studies’ Nonproliferation Education Award in 2009.

Lina Khatib is the co-founding Head of the Program on Arab Reform and Democracy at the Center on Democracy, Development, and the Rule of Law at Stanford University. She joined Stanford University in 2010 from the University of London where she was an Associate Professor. Her research is firmly interdisciplinary and focuses on the intersections of politics, media, and social factors in relation to the politics of the Middle East. She is also a consultant on Middle East politics and media and has published widely on topics such as new media and Islamism, US public diplomacy towards the Middle East, and political media and conflict in the Arab world, as well as on the political dynamics in Lebanon and Iran. She has an active interest in the link between track two dialogue and democratization policy. She is also a Research Associate at SOAS, University of London, and, from 2010-2012, was a Research Fellow at the USC Center on Public Diplomacy at the Annenberg School.

Lina is one of the core authors of the forthcoming Arab Human Development Report (2013) published by the UNDP, and a member of the Board of Directors of the Syria Justice and Accountability Center. She is also a founding co-editor of the Middle East Journal of Culture and Communication, a multidisciplinary journal concerned with politics, culture and communication in the region, and in 2009 co-edited (with Klaus Dodds) a special issue of the journal on geopolitics, public diplomacy and soft power in the Middle East. She edited the Journal of Media Practice from 2007-2010.

Paul Wise is the Richard E. Behrman Professor of Child Health and Society, Professor of Pediatrics at Stanford University School of Medicine, and Senior Fellow in the Freeman Spogli Institute for International Studies at Stanford University.  He is Director of the Center for Policy, Outcomes and Prevention and a core faculty of the Centers for Health Policy and Primary Care Outcomes Research, at Stanford University.

Dr. Wise received his A.B. degree summa cum laude and his M.D. degree from Cornell University, a Master of Public Health degree from the Harvard School of Public Health and did his pediatric training at the Children's Hospital in Boston.  His former positions include serving as the Director of Emergency and Primary Care Services at the Children's Hospital, Boston, Director of the Harvard Institute for Reproductive and Child Health at Harvard Medical School, and Special Assistant to the U.S. Surgeon General.  Prior to moving to Stanford University, Dr. Wise was Vice-Chief of the Division of Social Medicine and Health Inequalities in the Department of Medicine, Brigham and Women's Hospital and Harvard Medical School, the academic and research base of Partners in Health.

Rajaie Batniji is a resident physician in internal medicine at Stanford and a CDDRL affiliate. His research examines the selection of priority diseases and countries in global health, and he is interested in global health financing and the priority-setting process of international institutions. His work has also examined social determinants of health in the Middle East. At FSI, Dr. Batniji is co-investigator on Global Underdevelopment Action Fund projects explaining U.S. global health financing and political causes of public health crisis.

Dr. Batniji received his doctorate in international relations (D.Phil) from Oxford University where he studied as a Marshall Scholar. He also earned a M.D. from the University of California, San Francisco School of Medicine and M.A. and B.A. (with distinction) degrees in History from Stanford University. Dr. Batniji was previously based at Oxford's Global Economic Governance Program, and he has worked as a consultant to the World Health Organization.

Dr. Paul Wise is dedicated to bridging the fields of child health equity, public policy, and international security studies. He is the Richard E. Behrman Professor of Child Health and Society and Professor of Pediatrics, Division of Neonatology and Developmental Medicine, and Health Policy at Stanford University. He is also co-Director, Stanford Center for Prematurity Research and a Senior Fellow in the Center on Democracy, Development, and the Rule of Law, and the Center for International Security and Cooperation, Freeman Spogli Institute for International Studies, Stanford University. Wise is a fellow of the American Academy of Arts and Sciences and has been working as the Juvenile Care Monitor for the U.S. Federal Court overseeing the treatment of migrant children in U.S. border detention facilities.

Wise’s most recent U.S.-focused work has addressed disparities in birth outcomes, regionalized specialty care for children, and Medicaid. His international work has focused on women’s and child health in violent and politically complex environments, including Ukraine, Gaza, Central America, Venezuela, and children in detention on the U.S.-Mexico border.
