Access to life-saving pharmaceuticals and medical treatments is a nagging problem for millions of Latin Americans. In several countries of the region, judicial actions for the protection of basic rights have proved to be instrumental for gaining access to such goods. Brazil and Colombia are, allegedly, the two Latin American countries with the largest number of right to health cases. Everaldo Lamprea suggests that dismantling right to health litigation in order to reduce public costs--as was recently proposed by the Colombian government-- would be a catastrophic event for many Colombians, trapped in a heavily privatized and deregulated health system where many life-saving pharmaceuticals and medical treatments are out of the reach of most pockets. Lamprea will suggest that a more reasonable governmental reaction should include an analysis of the role played in the current health-sector crisis by global actors such as International Financial Institutions and BigPharma companies

On November 5-6  2010, the global Network of Democracy Research Institutes (NDRI) convened a conference in Quito, Ecuador, on "Political Clientalism, Social Policy, and the Quality of Democracy: Evidence from Latin America, Lessons from Other Regions." The meeting was cosponsored by three NDRI member institutes: the Washington-based International Forum for Democratic Studies (IFDS) of the National Endowment for Democracy (NED), Ecuador's Grupo FARO, and the Program on Poverty and Governance at the Center on Democracy, Development, and the Rule of Law (CDDRL).

The conference aimed to explore, in comparative framework, the modus operandi of political clientalism in the realm of social policies as well as the strategies that might be employed to combat it. The conference brought together 21 scholars and practitioners from around the world, including several from South America, particularly the Andean region. Participants from CDDRL included; Larry Diamond, Beatriz Magaloni, Francis Fukuyama, and Simeon Nichter.

Please see the attached conference report, which summarizes the main issues and key findings discussed at the meeting. The papers presented at the conference will be compiled into a volume edited by Diego Abente, deputy director of the International Forum for Democratic Studies at NED.

Egyptian activists made history in February 2011 when they overturned a thirty-year dictatorship, in part thanks to their mastery of social media.

On April 4, the Center on Democracy, Development, and the Rule of Law at Stanford University together with the Cloud to Street Initiative, will be holding a Digital Townhall meeting to connect activists who were leading the protest movement in Cairo with researchers at Stanford, Harvard, and the University of British Columbia. This will be an opportunity to hear directly from activists about their experiences leading protests, using social media to influence events, and what assistance they could use to increase their influence going forward. 

The format will include a panel of four activists speaking by live video feed, with participants in North America sending questions by chat. You may log in to the conversation from any internet connection, or you may join us in person from the CISAC conference room in Encina Hall.

Early in the Supreme Court oral arguments in Kiobel v. Royal Dutch Petroleum Co., Justice Kennedy alerted the plaintiffs' lawyer that, for him, "the case turns on this:... 'No other nation in the world permits its court to exercise universal civil jurisdiction over alleged extraterritorial human rights abuses to which the nation has no connection." That statement, quoting an amicus brief filed for one of the defendants, is true when taken literally, but is misleading inasmuch as it fails to take into account that analogous suits are allowed in teh civil-law world of Continental Europe if one knows how to go beyond the literal, as transposing from one legal system into another requies. Universal jurisdiction for jus cogens violations has found a fooring in the criminal law of civilian States for reasons tied to deep systemic attributes not shared by the United States legal order.

Turkey redefined its geographical security environment over the last decade by deepening its engagement with neighboring regions, especially with the Middle East. The Arab spring, however, challenged not only the authoritarian regimes in the region but also Turkish foreign policy strategy. This strategy was based on cooperation with the existing regimes and did not prioritize the democracy promotion dimension of the issue. The upheavals in the Arab world, therefore, created a dilemma between ethics and self-interest in Turkish foreign policy. Amid the flux of geopolitical shifts in one of the world’s most unstable regions, Turkish foreign policy-making elites are attempting to reformulate their strategies to overcome this inherent dilemma. The central argument of the present paper is that Turkey could make a bigger and more constructive impact in the region by trying to take a more detached stand and through controlled activism. Thus, Turkey could take action through the formation of coalitions and in close alignments with the United States and Europe rather than basing its policies on a self-attributed unilateral pro-activism.

Why have militarized crackdowns on drug cartels had wildly divergent outcomes, sometimes exacerbating cartel-state conflict, as in Mexico and, for decades, in Brazil, but sometimes reducing violence, as with Rio de Janeiro's new 'Pacification' (UPP) strategy?  CDDRL-CISAC Post Doctoral Fellow Benjamin Lessing will distinguish key logics of violence, focusing on violent corruption--cartels' use of coercive force in the negotiation of bribes. Through this channel, crackdowns can lead to increased fighting unless the intensity of state repression is made conditional on cartels' use of violence--a key difference between Mexico and Brazil.

PRC-ROK Summit Underscores Shared Interests and Common Concerns

South Korean President Park Geun-hye’s visit to China this week attests to the magnitude and importance of geostrategic changes in Northeast Asia.  Just a few years ago, such a visit might have been widely interpreted as a sign of tension in the U.S.-ROK relationship and an attempt by Beijing to undermine the alliance.  Now it is viewed, correctly, as a natural and necessary meeting between leaders with many shared interests and common concerns, above all about the behavior and intentions of the DPRK.
 
When Presidents Park and Xi Jinping meet, each will have met recently with President Obama.  Neither will have met with Kim Jong Un since assuming their current positions.  The symbolism of this difference reflects the reality that Park, Xi, and Obama have far more shared interests than any of them has with Kim or his regime.  Indeed, key objectives of all three summits include strengthening bilateral ties and preserving peace in the world’s most dynamic region.
 
Much of the Park-Xi agenda will be devoted to economic and trade issues and opportunities, and to other bilateral and global challenges.  But both leaders recognize that North Korean actions pose the greatest threat to regional peace and the continued prosperity of their own nations.  Their discussions should, and will, devote much time and attention to what each can do, individually, jointly, and with the United States, to persuade Pyongyang to change its dangerous and counterproductive behavior.
 
After testing three nuclear devices, Pyongyang is now openly threatening the United States with a pre-emptive nuclear attack and has engaged in nuclear proliferation with a number of countries. While Pyongyang says its nuclear program is directed only against the United States, many South Koreans believe that the North’s possession of nuclear devices emboldened it to launch two deadly conventional attacks on the South in 2010. What more might Pyongyang do, they fear, if it continues on its current path?
 
North Korea has developed nuclear weapons and delivery systems because it feels threatened from all sides and judges that, unlike the South, it has no reliable ally.  But the real threat to the regime comes from within, not from without. Its misguided policies impoverish its people and prevent the DPRK from following a path of reform and opening to the outside world that has brought stability and prosperity to all of its neighbors, a path that Chinese leaders have urged on Pyongyang for over two decades. 
 
Pyongyang’s leaders seem to have deluded themselves into believing that nuclear weapons will ensure both their security and economic prosperity—even though neither Washington nor Seoul had or has any intention to attack the North, and Pyongyang has long had the functional equivalent of weapons of mass destruction in its thousands of artillery tubes pointed at Seoul. They mistakenly think that Washington will eventually tire of resisting and accept the North as a nuclear weapons state, but no American president will establish diplomatic relations and support removing sanctions on North Korea until it verifiably abandons nuclear weapons.
 
In recent weeks, North Korea has called for bilateral talks with both the United States and South Korea. While it characterized those offers as "unconditional," its own statements made it clear that it regards any talks as being premised on its being and remaining a nuclear weapons state, a condition it knows neither Washington nor Seoul can accept.
 
Before Pyongyang moves farther down a path that threatens peace and security while, ironically, achieving none of its own goals, Park, Xi, Obama, and other regional leaders must seek to persuade Kim to discard failed policies in favor of proven alternatives. At the same time, they must find ways to contain the danger his regime will pose to the region and global nonproliferation efforts until he has an epiphany.
 
President Park said this week that the upcoming Korea-China summit “comes at a more important juncture than at any other time in terms of the situation on the Korean Peninsula.”  Without question, President Park’s summit in Beijing could well be one of the most consequential global diplomatic events of the year.
