Video: Donald K. Emmerson on Strategic Thinking in Southeast Asia
Abstract: In 2013, the Obama Administration’s “Nuclear Employment Strategy” guidance announced that all war plans and operations would be “consistent with the fundamental principles of the Law of Armed Conflict” (LOAC). The Trump Administration’s 2018 Nuclear Posture Review repeated this commitment. The literature on nuclear strategy and deterrence in political science however, has either ignored these legal requirements or misunderstood them. The legal literature on nuclear weapons, however, has largely ignored the technical revolution regarding improved accuracy and lower-yield nuclear weapons and the different strategic contexts in which the U.S. might contemplate nuclear use. This paper analyzes how proper application of the Law of Armed Conflict should constrain U.S. nuclear doctrine and war planning and how knowledge of strategic considerations is fundamental to proper legal analysis. We argue that the principle of proportionality can permit “counter-force” targeting— most clearly when such attacks can prevent or significantly reduce the expected damage to U.S. and allied populations with lower foreign collateral damage. We also argue that the legal requirement to take “feasible precautions” to protect non-combatants means the U.S. must use conventional weapons or the lowest yield nuclear weapons possible in any counterforce attack. Finally, we contend that the prohibition against deliberate targeting of civilians has gained the status of customary international law and that the U.S. government should therefore reverse its traditional position and reject the doctrine of “belligerent reprisal” against foreign civilians. This prohibition means that it is illegal for the United States, contrary to what is implied in the 2018 NPR and explicitly maintained by prominent U.S. Air Force lawyers, to either intentionally target civilians in reprisal to a strike against U.S. or allied civilians, or launch attacks against legitimate military targets if the intent to is cause incidental civilian harm.

Sagan is the author of Moving Targets: Nuclear Strategy and National Security (Princeton University Press, 1989); The Limits of Safety: Organizations, Accidents, and Nuclear Weapons (Princeton University Press, 1993); and, with co-author Kenneth N. Waltz, The Spread of Nuclear Weapons: An Enduring Debate (W.W. Norton, 2012). He is the co-editor of Learning from a Disaster: Improving Nuclear Safety and Security after Fukushima (Stanford University Press, 2016) with Edward D. Blandford and co-editor of Insider Threats (Cornell University Press, 2017) with Matthew Bunn. Sagan was also the guest editor of a two-volume special issue of Daedalus: Ethics, Technology, and War (Fall 2016) and The Changing Rules of War (Winter 2017).

In 2018, Sagan received the Andrew Carnegie Fellowship from the Carnegie Corporation of New York. In 2017, he received the International Studies Association’s Susan Strange Award which recognizes the scholar whose “singular intellect, assertiveness, and insight most challenge conventional wisdom and intellectual and organizational complacency" in the international studies community. Sagan was also the recipient of the National Academy of Sciences William and Katherine Estes Award in 2015, for his work addressing the risks of nuclear weapons and the causes of nuclear proliferation. The award, which is granted triennially, recognizes “research in any field of cognitive or behavioral science that advances understanding of issues relating to the risk of nuclear war.” In 2013, Sagan received the International Studies Association's International Security Studies Section Distinguished Scholar Award. He has also won four teaching awards: Stanford’s 1998-99 Dean’s Award for Distinguished Teaching; Stanford's 1996 Hoagland Prize for Undergraduate Teaching; the International Studies Association’s 2008 Innovative Teaching Award; and the Monterey Institute for International Studies’ Nonproliferation Education Award in 2009.
Senior Lecturer Weiner is director of the Stanford Program in International and Comparative Law and co-director of the Stanford Center on International Conflict and Negotiation. Before joining the Stanford Law School faculty in 2003, Weiner served as legal counselor to the U.S. Embassy in The Hague and attorney adviser in the Office of the Legal Adviser of the U.S. Department of State. He was a law clerk to Judge John Steadman of the District of Columbia Court of Appeals.
Robert R. King was a Visiting Scholar, Koret Fellow at the Walter H. Shorenstein Asia-Pacific Research Center (Shorenstein APARC) during the 2019 fall term. He is the former U.S. Special Envoy for North Korean Human Rights Issues at the U.S. Department of State (2009-2017). He is Special Advisor to the Korea Chair at the Center for Strategic and International Studies (CSIS), a non-resident Fellow at the Korea Economic Institute, and a member of the board of the Committee for Human Rights in North Korea.
Ambassador King’s research interests include North Korea human rights, Northeast Asia, U.S. foreign policy, and the Congressional role in U.S. foreign affairs. During his time at Shorenstein APARC, he researched the United States efforts to promote human rights in North Korea.
Before assuming his position at the Department of State, King was Staff Director and Minority Staff Director of the Foreign Affairs Committee of the U.S. House of Representatives (2001-2009). He served as Chief of Staff to Congressman Tom Lantos of California (1983-2008). He was a White House Fellow on the staff of the National Security Council (1977-1978), and Senior Analyst and Assistant Director of Research at Radio Free Europe in Munich, Germany (1970-1977).
King holds a PhD and an MALD in international relations from the Fletcher School of Law and Diplomacy and a BA in political Science from Brigham Young University.
Tesalia Rizzo holds a Ph.D. in Political Science at the Massachusetts Institute of Technology (MIT). Her research focuses on the demand and supply side of political mediation. Specifically, on how political (formal, informal or clientelist) intermediaries shape citizens’ attitudes and political engagement. She also works with non-governmental practitioners in Mexico to develop and test policies that disincentivize citizen reliance on clientelist and corrupt avenues of engaging with government and strengthen citizen demand for accountability. Her work with Mexican practitioners was awarded the 2017 Innovation in Transparency Award given by the Mexican National Institute for Access to Information (INAI). She is also a Research Fellow at MIT GOV/LAB and the Political Methodology Lab, at MIT. She is a graduate of the Instituto Tecnológico Autónomo de México (ITAM) in Mexico City. Prior to arriving at Stanford, she was a pre-doctoral fellow at the Center for US-Mexican Studies at University of California, San Diego and will join the Political Science Faculty at the University of California, Merced in 2020.

We are delighted to announce that APARC’s Oksenberg-Rohlen Fellow David M. Lampton is the recipient of the 2019 John and Vivian Sabel Award for best article published in the Journal of Contemporary China (JCC), for his article “Xi Jinping and the National Security Commission: Policy Coordination and Political Power.”
Lampton’s article discusses the rationale for, and progress to date of, creating a National Security Commission in China. First announced in late 2013, the commission was part of Xi Jinping's drive to consolidate his personal power over the internal and external coercive and diplomatic arms of the governing structure. Lampton argues that it remains to be seen whether the institutional attempt to achieve coordination will improve, or further complicate, China's long-standing coordination problem.
The John and Vivian Sabel Award was launched in 2016 to celebrate publication of the 100th issue and the 25th anniversary of the JCC. Dr. Lampton’s article was published in Volume 24, Issue 95, 2015.

Abstract: Did the Cold War of the 1980s nearly turn hot? Much has been made of NATO’s November 1983 Able Archer 83 command post exercise, which the literature typically casts as having nearly precipitated a nuclear war. Warsaw Pact policy-makers, according to the conventional wisdom, suspected that the exercise was more than just a rehearsal of nuclear escalation and concluded that a surprise nuclear attack was imminent, nearly launching a preemptive strike of their own. This article overturns this narrative using new, international evidence from the political, military, and intelligence archives of the Eastern bloc. First, it shows that the much-touted Warsaw Pact intelligence effort to assess Western intentions and capabilities, Project RIaN, which supposedly triggered Eastern fears of a surprise attack was nowhere near operational at the time of Able Archer 83. Second, it presents an account of the East’s sanguine observations of Able Archer 83 disproving accounts which allege that the exercise nearly escalated to nuclear war. In doing so, it advances debates not only in the historiography of the late Cold War, but also pertaining to the stability of the nuclear peace and the role of perception and misperception in policy-making.

After the events of the Revolution of Dignity, Ukraine made a decisive historic choice in its shift towards democracy, notwithstanding current threats to security and sovereignty from Russia’s annexation of Crimea and the war in Donbas. Due to these circumstances, Ukraine is on the frontline of democracy between Russia and the West. In 2019, Ukrainians are facing major decisions in their country’s democratic development with the presidential and parliamentary elections. During the 2019 Presidential elections Ukrainians elected Volodymyr Zelenskiy, a former actor with no political background, with 73% of the vote. The more important Parliamentary elections are yet to come in the fall, and the resulting coalition will shape the future government.
In light of the elections the Ukrainian Emerging Leaders Program at the Stanford University Center on Democracy, Development and the Rule of Law has gathered DC-based policy makers, high-level Ukrainian state officials and parliamentarians to discuss lessons that should be learned from the presidential elections, and what can we take away looking toward the October 2019 parliamentary elections.
The Ukrainian Emerging Leaders Program at the Stanford University Center on Democracy, Development and the Rule of Law has organized a conference on these political developments to discuss pertinent policy issues that will affect Ukraine’s future. This conference reflects how UELP fellows are creating an important place for conversation on global development and Ukraine at Stanford University by raising key questions about the country’s future direction. They are also providing knowledge to their own community by connecting stakeholders in Ukraine to resources at Stanford and Silicon Valley.

Since the Revolution of Dignity, Ukraine has been scrutinized for its record on implementing reforms. However, in the past five years there have been many more success stories than in the history of Ukrainian independence prior to 2014. On January 5, 2019 the tomos of autocephaly of the Ukrainian Orthodox Church was signed, thus granting independence for the Ukrainian church, after centuries of subjugation to Russia. This was a historic move for Ukraine on many levels, from its cultural significance to its role in fighting Russian propaganda as the churches under the Moscow Patriarchate were massively used for propaganda Since then, at least 340 parishes that were formerly under the Moscow Patriarchate have joined with the newly independent church. The creation of an independent Ukrainian Orthodox Church is a watershed moment in the global understanding of Ukrainian identity.

In light of the upcoming 2019 parliamentary elections you will have the opportunity to meet representatives from major political parties and movements who are considered up and coming reformers in Ukraine. The 2018 Kerch Strait incident not only demonstrated the relentlessness of Russia’s continued incursions on Ukrainian sovereignty, but raised questions as to how Ukraine and the West should act in light of such attacks. Whoever wins the spring 2019 presidential elections will face important strategic decisions in the war effort and cooperation with international allies.

IT industry is a growth engine of Ukraine’s economy. Ukraine IT outsourcing industry is a globally recognized leader. Tech ventures working with enterprise software, ML / AI, cyber security, life-science, big data management, gaming, agribusiness and e-commerce. Exports of Ukrainian ICT services is the third largest export sector showing constant growth. Foreign investments into the industry are increasing ($285 mln in 2018). Moreover, the number of SMEs tech companies is growing as well (4,000+ IT companies). Furthermore, from year to year the number of successful tech ventures with Ukrainian founding teams and R&D offices in Silicon Valley is increasing. Ukraine has the largest and fastest-growing engineering talent pool in Europe with 160,000 specialists in 2018 and 242,000 prognosis by 2025. The country’s universities and polytechnic institutes graduate over 100,000 new engineers annually incl. 23000+ IT graduates.

To contain and thwart the malicious effects of “Putinism,” the United States government and the American people must first understand the nature of the threat. This testimony focuses onthe nexus of political and economic power within Russia under Putin’s leadership, and how these domestic practices can be used abroad to advance Putin’s foreign policy agenda. Moreover, it is important to underscore that crony capitalism, property rights provided by the state, bribery, and corruption constitute only a few of many different mechanisms used by Putin in his domestic authority and foreign policy abroad.
This testimony proceeds in three parts. Section I describes the evolution of Putin’s system of government at home, focusing in particular on the relationship between the state and big business. Section II illustrates how Putin seeks to export his ideas and practices abroad. Section III focuses on Putin’s specific foreign policy objective of lifting sanctions on Russian individuals and companies.

Allen was far less confident, however, about the prospects of addressing structural issues with China, that is, areas where the Chinese economy is an outlier to the global economy, violates WTO rules, and greatly differs from OECD norms. This is because these core dimensions touch on the role of the Chinese Communist Party (CCP) in the government and in the economy.
He counted among these structural issues the enormous role of state-owned enterprises (SOEs); the scale of subsidies going to the technology sector and their lack of transparency; prohibitions on foreign investment in sensitive industries like telecommunications and media; the unequal treatment of foreign companies; discriminatory implementation of regulations and the lack of an appeals process; uneven implementation of IP rights; the outsized role of the CCP in the economy; the dominant role of industrial policy; Xi Jinping government’s aggressive techno-nationalism, which is manifested in its calls for indigenous innovation and for self-reliance; and its excessive control over the information space.
“China is willing to make cosmetic changes to these problems,” said Allen, “even muscular changes, but no changes to the skeleton, the core, the system under which the CCP has complete control.”
A trade deal might remove the immediate threat of tariffs as a source of friction between the United States and China, noted Allen, but the essence of the conflict is not about trade: rather, it has to do with technology. “The trade war will morph into a technology war,” he predicted, and 2019 will mark a change in that direction, making life much more complicated for both American—especially Silicon Valley—and Chinese companies.
Both the United States and China are now locked in a “security dilemma,” noted Allen. “One side takes defensive measures which the other side perceives as aggressive measures,” and “we are ratcheting up on national security.” The U.S. Department of Commerce, for instance, is looking to change the ways of dealing with Chinese companies and to expand export controls, extending their scope to a whole new category of “emerging technologies,” regarding whose definition there is intensive debate in Washington. Depending on its scope, a broad definition could jeopardize hundreds of thousands of projects and disrupt investment and global supply chains.
On the Chinese side, Allen noted, there is a parallel process going on. In 2019, we should expect China to similarly impose tightened export controls, he cautioned, cybersecurity law, personal identification information law, data localization requirements, and a strengthened national security law that, among other requirements, will ratchet up audit requirements of American companies seeking market access and the type of companies allowed to have only Chinese-origin equipment.
Both countries have given in to exaggerated security concerns that threaten the global commons, argued Allen. “American and Chinese companies have worked together in the innovation space for years in a beautiful manner. It has been a remarkably productive exercise over the last four decades that brought tremendous benefit for everyone. You can't imagine a company like Apple without China, and you can't imagine China without a company like Apple. Now all this is being put into question.”
The heightened security measures on both sides are fraught with threats to research institutions, businesses, and the innovation ecosystem at large. Academic exchanges, students, and professors will be deemed exports of knowledge subject to technology licensing laws, cautioned Allen. He asked: “How many thousands of collaborative research ventures will be impacted?”
We are entering the technology war at the wrong time, said Allen, just as China is becoming a middle-income country with hundreds of millions of middle-class citizens who want to buy American-made goods and services that U.S. companies want to sell to them. Now is the time to take advantage of China’s transitioning to a consumption-led economy, he claimed, and “become a good friend of Chinese middle-class consumers.”
China is also forging ahead with its innovative economy, particularly in areas such as AI, 5G, and aspects of the life sciences. “This isn’t a one-way street,” emphasized Allen. “We need their brains as much as they need ours […] China will remain an innovative country, and we need to deal with that.”
“This is not a time to panic,” he pointed out, “but a time to reset and ask: ‘What are the rules of the road for technology cooperation and competition? What are the rules for enforcement and how do we enforce the new rules fairly?”
“If China follows its WTO obligations then we would get there,” Allen claimed. “But if President Xi is going to be single-minded about self-reliance and cutting foreign influence on the Chinese economy, then we’re up for rough sledding and 2019 will be a definitive year in determining the course forward.”
Trade deal or no deal, in the U.S.-China race for technology supremacy, he concluded, trust is a commodity in short supply.
